Limited
Warranty
Section 1: Introduction
This limited warranty is provided by: Eco-Building
& Forestry, LLC.
1058 DuBay Dr. Mosinee, WI 54455
This limited warranty is extended only to customers
who make purchases directly from Eco-Building & Forestry, LLC. and is not
extended to subsequent purchasers or owners.
Section 2: Choices Customers Can Make At The Time
Of Purchase
Customers of Eco-Building and Forestry can choose one
of three options when making purchases.
- Wholesale Purchases No Warranty
Plants and non-vegetative products offered in
Eco-Building & Forestry, LLC. literature, catalogs, fliers, proposals,
estimates and other advertisements are at wholesale price and do not carry a
limited warranty, unless otherwise noted. These purchases are "cash and
carry" or "delivered" and can not include installation or other
services. All other purchases, including wholesale purchases of products are
sold without a limited warrant and do not have any implied or expressed warranty
accept as required by federal and state law.
2. One Year Limited Warranty
Eco-Building & Forestry, LLC will provide
replacement or refunds for 1 year from the date of purchase on defective plants,
trees, shrubs, perennials, vines, non-vegetative products and/or services that
carry a 1 year limited warranty. Only the plants, non-vegetative products and
services labeled "One Year Limited Warranty" on price sheets,
proposals and invoices carry the one year limited warranty.
2. Three Year Limited Warranty
Eco-Building & Forestry, LLC will provide
replacement of defective plants, trees, shrubs, perennials, vines,
non-vegetative products, and services for 3 years when a 3 year maintenance
agreement with Eco-Building & Forestry, LLC. was included in the original
purchase.
Service and or replacement under the 3 year limited
warranty will be handled during maintenance agreement visits and all other
warranty requirements apply except for return, delivery and reinstallation of
the defective plants or non-vegetative products will be provided at no cost to
the purchaser. Additional requested visits under the 3 year limited warranty
will be invoiced at regular rates and paid for by the purchaser.
Section 3: What Is Covered And What Costs The
Customer Accepts And Agrees To
The limited warranty only covers:
-
Retail purchases of plants, trees, shrubs,
perennials, and vines from Eco-Building & Forestry, LLC.
-
Retail purchases of non-vegetative products
including irrigation kits, artificial boulders, and plant protection devices
from Eco-Building & Forestry, LLC.
-
Services including installation of plants,
patios, walks and ponds provided by Eco-Building & Forestry, LLC.
Warranty claims and adjustments will be provided by
Eco-Building & Forestry, LLC in accordance with Section 3, 4 and 5 of this
document for manufactured products, such as pumps and lighting fixtures, that
carry their own limited warranty and that were sold by Eco-Building &
Forestry, LLC.
Eco-Building & Forestry, LLC. charges a $5.00
handling fee for each warranty claim handled at it’s business location. An
additional charge of $1.00 per mile for the round trip is assessed for requests
to visit a purchaser’s site for a warranty claim.
Eco-Building & Forestry, LLC. at their discretion
will repair or replace, or refund the purchase price of defective plants, trees,
shrubs, perennials, vines and non-vegetative products or installations but will
not reimburse for handling, shipping, delivery, site visits or any other
incidental cost incurred by the purchaser.
The purchaser, at their expense, must return the
defective plant(s) or defective material(s) to Eco-Building & Forestry, LLC.
Costs for removal, shipping, delivery, reinstallation, loss of use and other
incidental costs are the sole responsibility of the purchaser.
Section 4: Exclusions/What This Warranty Does Not
Cover
All of the following exclusions apply to the 1 year
limited warranty and the 3 year limited warranty:

Damage to plants, materials or installations by:
failure to water or improper watering, damage in transit, neglect, improper
maintenance, storms, floods, heavy rain, lightening, animals (such as, but
not limited to, deer, rabbits, voles, moles, beavers, muskrats, horses,
cows, dogs, children and cats), vandalism, recreational activities,
automobiles, trucks, construction equipment, lawn mowers, weed eaters,
boats, boat wake, falling and wind driven ice, pesticides, herbicides,
fertilizers, salt, chemicals in the soil or air, piled snow, hail, ice
storms, alterations, improper use and/or placement, acts of God, acts of
war, acts of terrorism, fire, improper storage, insects, diseases, mold,
mildew, fungi, algae, weeds, undesirable plants, weed seeds, natural or
manmade erosion forces.

Lack of maintenance by the purchaser by: Failure
to water, failure to provide protection to plants and materials, failure to
make sure irrigation systems work properly, freeze damage to pumps and
irrigation.

Plants and plant materials including: seeds, root
stock, bareroot plants, tubers, bulbs, cuttings.
-
Biodegradable products including: Bark and other
mulches, Eco-Weed Barrier, coir and jute erosion control products, net tubes
and tree shelters, untreated wood stakes.

Pesticide and fertilizer application services
including: fungicide applications, herbicide applications, insecticide
applications, removal of weeds and undesirable plants, pesticide
applications to invasive plants, crab grass prevention, granular and liquid
fertilizer applications.
Section 5: Procedure For All Limited Warranty
Claim
-
The customer must call 715-344-2817 for a return
appointment for plants and non-vegetative products, directions for return of
product or to request an on-site visit for a limited warranty claim of an
installed product.
-
Any warranty claim must then be mailed to the
Eco-Building & Forestry, LLC. business location and must be accompanied by
a written description of the problem with purchasers name/address/phone
number, original receipt and packaging, and a check or credit card number for
the $5.00 handling charge and/or $1.00 per mile round trip visit.

Eco-Building & Forestry, LLC. will then provide
the customer with an estimate for repairs or replacement if the defective item
is not covered by the limited warranty.

Eco-Building & Forestry, LLC. will provide a
cost estimate for return shipping or delivery if the customer does not want to
provide pick up of the replacement product.
-
Eco-Building & Forestry, LLC. will provide
return of the purchase price of the defective product, if a similar item is
not available in a reasonable time as determined by Eco-Building &
Forestry, LLC.

The customer must contact the manager of
Eco-Building & Forestry, LLC. at (715) 344-2817 prior to pursuing any
legal remedies for any warranty claim.
All disputes will be handled by the Manager of
Eco-Building & Forestry, LLC.
Purchasers may pursue legal remedies allowed under
state and federal law after completing all procedures for limited warranty
claims.
Because of the seasonal nature of landscaping
products, limited warranty replacements may only
be available at certain times of the year. Customers
may be required to wait for warranty claim or adjustment
until the replacement
product(s) are available.
This limited warranty gives you specific legal rights
in Wisconsin, and you may also have other rights, which may vary from state to
state.
